What is Bail?

“Bail” is a cash deposit or pledge to a court in order to persuade it to release a suspect from jail, with the understanding that the suspect will return for trial or forfeit the bail (and possibly be brought up on charges of the crime of failure to appear). Bail money may be returned by the end of the trial, if all court appearances are made, regardless of whether the person is found guilty or not guilty of the accused crime.

A “bail bond” (surety bond) is a financial guarantee to the court that the defendant will appear in each and every court appearance as the court directs. If the bonded inmate fails to comply with court conditions, a warrant will be issued, and bail bonds forfeited. 


How Much Does a Bail Bond Cost?

Generally, premium bail bonds are set at 10% of the full bail amount, established by surety companies and regulated by the Department of Insurance. So, if you bail is set at $10,000, the defendant will need $1,000 to bail out.

How Long is a Bail Bond Good For?

A bail bonds are good for one year. If the defendants court case extends past a year, a new premium will need to be purchased to keep the bail bond current and active. 


Who is Liable for The Bail Bond?

Whoever CO-SIGNS the bail bond contract is financially liable for the full-face of the bond.
